Terms of Service

Beta notice. Tau Kgosi Capital is in limited beta. These terms will evolve as the service matures. Continued use after updates constitutes acceptance.

1. Who we are

Tau Kgosi Capital ("we", "us", "the Service") is a software platform operated by [COMPANY LEGAL NAME, e.g. Tau Kgosi Capital (Pty) Ltd], registered in the Republic of South Africa under company number [REG NUMBER], with its registered office at [ADDRESS]. 2. What the Service is (and is not)

Tau Kgosi Capital provides algorithmic trading software tools which the user installs against their own MetaTrader 5 brokerage account. The Service:

Generates trade signals and automates order placement on accounts you own and control.
Provides performance reporting, Telegram notifications, and a web dashboard.

The Service is NOT:

Investment advice, financial planning, or portfolio management.
A regulated financial product or discretionary asset management service.
A guarantee of profit. Past performance does not guarantee future results.

You remain the sole owner and controller of your brokerage account. You are solely responsible for funding it, withdrawing from it, and bearing all market risk.

3. Risk disclosure

Trading leveraged instruments (forex, CFDs, commodities, cryptocurrency) carries a substantial risk of loss. You can lose more than your initial deposit. Algorithmic trading does not eliminate market risk — it changes the shape of it. You should not use the Service with funds you cannot afford to lose. You are responsible for understanding the risks and confirming the Service is appropriate for your personal financial situation.

4. Eligibility

To use the Service you must:

Be at least 18 years old;
Have legal capacity to enter binding contracts in your jurisdiction;
Provide accurate registration information and keep it up to date;
Comply with all laws of your country of residence, including those relating to trading, taxation, and foreign exchange controls (SARB regulations for South African residents).

5. Your account and credentials

You must keep your password and MT5 credentials confidential. You are responsible for all activity under your account. Notify us immediately at security@taukgosicapital.co.za of any suspected compromise. We store MT5 credentials encrypted but cannot guarantee absolute security — see the Privacy Policy.

6. Fees and beta access

The Service is currently offered free of charge to beta participants. We reserve the right to introduce paid subscription tiers with at least 30 days' written notice to active users. You will never be charged without your explicit consent.

7. Intellectual property

The Service's strategy logic, source code, scoring algorithms, calibration methodology, and internal strategy names are our confidential intellectual property. You may not reverse-engineer, redistribute, or publish them. Trade results displayed on your account remain yours.

8. Acceptable use

You may not use the Service to:

Engage in market manipulation, front-running, or conduct prohibited by your broker or regulator;
Interfere with our infrastructure (rate-limit bypass, scraping, credential stuffing);
Attempt to extract or redistribute strategy logic;
Use the Service on behalf of third parties without our written consent (no "copy trading" onto managed accounts).

9. Limitation of liability

To the maximum extent permitted by law:

The Service is provided "as is" without warranties of any kind, express or implied.
We are not liable for trading losses, missed trades, broker errors, MT5 downtime, exchange outages, network failures, or events outside our reasonable control (force majeure).
Our total aggregate liability to you under these terms is limited to the fees you have paid us in the 12 months preceding the claim, or ZAR 1,000 if no fees were paid.

Nothing in these terms excludes liability which cannot lawfully be excluded under South African law.

10. Suspension and termination

We may suspend or terminate your access immediately if: (a) you breach these terms; (b) we are required to do so by law or regulation; (c) we reasonably suspect fraudulent or harmful use. You may terminate your account at any time by contacting us — see section 11 of the Privacy Policy for data handling on termination.

11. Changes to these terms

We may update these terms. Material changes will be notified by email to the address on your account and posted at this URL with a revised "Last updated" date. Continued use after changes take effect means you accept them.

12. Governing law and disputes

These terms are governed by the laws of the Republic of South Africa. Disputes will first be addressed through good-faith negotiation. If unresolved, the parties submit to the exclusive jurisdiction of the courts of [PROVINCE OF REGISTERED OFFICE], South Africa.
